These Terms and Conditions ("the Terms and Conditions") govern your ("the User") use of the Martini Bench ("Provider") website located at the domain name https://martinibench.com ("the Website"). By accessing and using the Website, the User agrees to be bound by the Terms and Conditions set out in this legal notice. The User may not access, display, use, download, and/or otherwise copy or distribute Content obtained on the website for marketing and other purposes without the consent of the Provider.

By using the Website or communicating with the Provider by electronic means, the User consents and acknowledges that any and all agreements, notices, disclosures, or any other communication satisfies any legal requirements, including by not limited to the requirement that such communications should be in writing.

E-Commerce & Privacy

The Website https://martinibench.com sells antique, vintage, and/or collectible items that have been previously owned along with new items. The use of any product or service brought from this Website is at the purchaser's risk. The purchaser/user indemnifies and holds the Provider harmless against any loss, injury or damages which may be sustained as a result of using the products sold on the Website.

The private information required for executing the orders placed through the e-commerce facility, namely, the User's personal information and credit card details, delivery address and phone numbers will be kept in the strictest confidence by the Provider and not sold or made known to third parties. Only the necessary information, that is the delivery address and contact phone number will be made known to the third parties delivering the product. Credit card details are not kept by the Provider under any circumstances.

The Provider cannot be held responsible for security breaches occurring on the User's electronic device (Personal Computer or other electronic device used to browse the Website), which may result due to the lack of adequate virus protection software or spyware that the User may inadvertently have installed on his/her device.

The Provider will supply all goods to the delivery company in good order as described in the description of the product. The Provider will not be held liable for the condition of goods arriving at the User's chosen delivery address. Any damages caused by the delivery service used for delivery must be reported to the Provider within 24 hours of arrival. The User must provide photos & personal information (name, phone number, and delivery address) that will be sent to the delivery company to determine liability. The User is not responsible for said data provided to the delivery company on usage nor storage.

Prohibitions

The User must not misuse this Website. The User will not: commit or encourage a criminal offense; transmit or distribute a virus, trojan, worm, logic bomb or any other material wich is malicious, technoligically harmful, in breach of confidence or in any way offensive or obscene; hack into any aspect of the Service; corrupt data; cause annoyance to other users; infringe upon the rights of any other person's proprietary rights; send any unsolicited advertising or promotional materials, commonly referred to as "spam"; or attempt to affect the performance or functionality of any computer facilities of or accessed through this Website. Breaching this provision would constitute a criminal offense and https://martinibench.com will report any such breach to the relevant enforcement authorities and disclose your identity to them.

Return and Refund Policy

Return Policy Procedure

If there is a problem with your Martini Bench purchase, simply contact us by email within 3 days of delivery of your item to arrange for its return and a refund of the purchase price.
Martini Bench will acknowledge your return request within 3 days.
You will ship the item back to Martini Bench within 3 days of the acknowledgement:
- The item must be returned via the original carrier (unless agreed otherwise in writing), in its original packaging, insured (if available) for its purchased price, and must be received in the same condition as when it was shipped to you with any identifying marks intact.
- We recommend you use delivery tracking and get a delivery receipt.
- The buyer pays for return shipping and insurance, unless agreed otherwise between the buyer and Martini Bench.

4. After Martini Bench verifies the returned item is as originally sent, they must issue a full refund within 3 days. This process can take 5 - 7 business days depending on credit card issuer.

Additional Return Policy Information

Damaged items are handled separately as described immediately below.
If you have any complaint against a Martini Bench purchase, you need to contact Martini Bench within 3 months (90 days) of the original purchase date to assist with the complaint.

Damaged Item Procedure

Please do not return items damaged in shipment, as doing so will void the shipping insurance.
Damage claims can only be made on items shipped with insurance.
Martini Bench requires that shipments over $100 be insured unless declined by the buyer. If a buyer requests that an item not be shipped insured when purchasing, Martini Bench is then not responsible for loss or damage to that item in shipping.
To begin the process, please contact Martini Bench and alert us to the damage.
Claims should be made through the original shipping agent. Guidelines for insurance claims vary by carrier so please check with the carrier for specific instructions.
Be sure to retain all original packaging as well as all pieces of the damaged item, as the shipping agent will request to examine them.
In the event that you, the recipient, files the claim, Martini Bench will provide you with the necessary insurance information.

Martini Bench’s Return Policy is designed to help ensure a smooth, enjoyable buying experience. If a transaction falls outside of our Return Policy, then you and Martini Bench will need to negotiate a mutually agreeable resolution. However, as a neutral party, you acknowledge that Martini Bench has no liability for the success or failure of your transaction and cannot guarantee its success.
